Terms of Service
For your safety & assurance
Welcome to "At A Party"! These Terms and Conditions ("Terms") govern your access to and use of the "At A Party" mobile application and website (together, the "Service"), operated by Breezer Ltd, which trades as "At A Party" ("we," "us," or "our"). By accessing or using "At A Party", you agree to comply with and be bound by these Terms, as well as our Privacy Policy, Acceptable Use Policy and Refunds Policy (collectively, the "Agreement").
Please read these Terms carefully. If you do not agree, you should not access or use the Service.
1. About "At A Party"
1.1 Purpose
"At A Party" is a dating app. You create a profile, browse other people, and start a "date": a short virtual meeting between your AI and theirs, which ends with a verdict on how well the two of you might get on. When it ends you can start a chat. Nothing in the Service guarantees that you will meet anyone, or that any relationship will result.
1.2 Eligibility
You must be at least 18 years old to use "At A Party". Use of the Service by anyone under 18 is strictly prohibited. By creating an account you confirm that you are at least 18, that you are legally able to enter into this Agreement and not prohibited by law from using the Service, that you are not required to register as a sex offender anywhere, and that you have not previously been removed from the Service.
1.3 Meeting people safely
We do not carry out criminal record or identity checks on our users, and we cannot guarantee that anybody is who they say they are. You are responsible for your own interactions with other users, online and offline. Take sensible precautions: never send money to somebody you have not met, meet in a public place, tell a friend where you are going, and report anyone who makes you uncomfortable. We are not responsible for the conduct of any user, whether on or off the Service.
1.4 Your AI
Your AI is an automated feature. It uses what you give it, such as your profile, your answers to our questions, anything you choose to paste in from ChatGPT or similar, and answers your friends write about you that you approve, to take part in dates on your behalf. Its scores, summaries and opinions are generated by artificial intelligence, are for entertainment and guidance only, and may be wrong, unfair or incomplete. They are not facts about you or about anyone else, and are not a substitute for getting to know a person.
1.5 Dates and gifts are virtual
A date in the Service is a virtual meeting between two AIs. Any gift or gesture bought or given in the Service is a digital item that appears in the app; nothing is delivered to anybody in the real world, and the price shown for a gift is what it costs in the Service, not the value of any real item.
2. Account Responsibilities
2.1 Registration
To use "At A Party" you must create an account, by verifying your email address. You agree to give truthful and complete information, including your real age and photos that show you, and to keep it up to date. You may have one account only.
2.2 Security
You are responsible for all activity under your account. Do not share your login credentials. Notify us immediately of unauthorised use.
2.3 Closing your account
You can close your account at any time from the account settings in the app. What we then delete and what we keep is described in our Privacy Policy.
2.4 Keeping the app up to date
Use the latest version of the app. We may stop supporting older versions, and may ask you to update before you can carry on.
2.5 Licence
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable licence to use the "At A Party" app on your own device for your personal, non-commercial use.
3. Purchases
3.1 What you can buy
"At A Party" is free to join. We also sell optional digital items inside the app, such as gifts on a date and chat unlocks. Prices are shown in the app, in your local currency, before you buy.
3.2 How you pay
Purchases are made through the Apple App Store or Google Play, and are processed by Apple or Google under their own terms. We never see your card details. Apple's or Google's terms apply to your purchase in addition to these Terms.
3.3 Delivery and your right to cancel
Digital items are delivered immediately. By buying one you ask us to deliver it straight away and you acknowledge that, once it has been delivered, you lose the right to cancel the purchase that the law would otherwise give you. This does not affect your rights if an item is faulty or not as described.
3.4 Refunds
Refunds are covered by our Refunds Policy. This excludes any rights you have under applicable law.
3.5 Digital items and free credits
Gifts, chat unlocks and credits are digital items for use in the Service only. They cannot be transferred, resold or exchanged for money. We may give you free credits, for example for using the app regularly; they have no cash value, and we may change or withdraw them for future use.
3.6 Subscriptions
If we offer a subscription in future, its price, billing period and renewal terms will be shown before you buy. It will renew automatically until you cancel, through your Apple or Google account, as described in our Cancellation Instructions.
3.7 Price changes
We may change prices at any time. A change does not affect anything you have already bought.
4. User Content and Conduct
4.1 Your content
You may submit text, photos, videos and other content to the Service, including your profile, your messages and your answers to our questions. You retain ownership of your content, but grant "At A Party" a worldwide, royalty-free, sub-licensable licence to host, store, reproduce, adapt and display it in connection with operating and promoting the Service, including showing your profile to other users and supplying it to your AI. We do not use your content to train our own AI models. You are solely responsible for what you submit and confirm that you have all rights necessary to submit it and to grant this licence.
4.2 Prohibited conduct
You agree to our Acceptable Use Policy. We may remove any content, and suspend or terminate any account, that we reasonably believe breaches that policy or these Terms.
4.3 No tolerance for objectionable content or abusive users
We have zero tolerance for objectionable content or abusive users on the Service. Content that is offensive, abusive, illegal, or otherwise in breach of our Acceptable Use Policy is not permitted, and users who behave abusively towards others are not welcome on the Service.
4.4 Moderation
Photos and videos you upload are checked by automated content moderation before they appear on your profile, and passed to a person where the result is unclear. We may remove content that does not meet our rules. Content removed for serious breaches may be kept as a record, as set out in our Privacy Policy. If you think we got it wrong, you can ask us to look at it again through our contact form.
4.5 Reporting and blocking
You can report objectionable content, or abusive users, to us at any time using the reporting tools within the app or via our contact form, and you can block any user. Please report in good faith: knowingly false reports, and harassing our staff, may lead to action against your account. Reporting a user also blocks them. We will review every report and remove any content we find to be objectionable within 24 hours of receiving the report. Where a user is found to have posted objectionable content or to have behaved abusively, we will also eject that user by suspending or terminating their account.
4.6 What we can do
If you breach these Terms we may warn you, remove content, restrict features, or suspend or terminate your account. An account removed for a breach is not entitled to a refund of anything unused. If you think we have made a mistake, tell us through our contact form and a person will look at it again.
4.7 Friends' answers
Anyone with your friend link can write answers about you. We do not publish them: they only reach your AI if you approve them, and you can delete any of them at any time. Do not pressure anyone to write about you, and do not write about anyone in a way that breaches our Acceptable Use Policy.
4.8 Copyright and other complaints
If you think something in the Service infringes your copyright or other rights, or you have any other complaint about content or how we have handled a report, tell us through our contact form with enough detail for us to find it, and we will look into it promptly.
5. Intellectual Property
5.1 Ownership
Breezer Ltd retains ownership of all proprietary aspects of the Service, including software, branding, and content (excluding your content and other users' content).
5.2 Feedback
If you provide feedback, you grant "At A Party" the unrestricted right to use it for any purpose.
6. Disclaimers and Limitation of Liability
6.1 Disclaimer of warranties
The Service is provided "as is" and "as available." We do not warrant that it will be uninterrupted or error-free, that any user is who they claim to be, or that you will meet or form a relationship with anyone.
6.2 Limitation of liability
To the fullest extent allowed by law, "At A Party" is not liable for indirect or consequential loss, or for the actions of users. Our total liability to you for anything arising from the Service is limited to the amount you paid us in the past 12 months or £100 GBP, whichever is greater.
6.3 Links and other companies
The Service may link to or show content from other companies, and the Apple App Store and Google Play are not parties to this Agreement. We do not endorse them and are not responsible for them or for their terms.
6.4 Losses you cause
To the extent the law allows, if your breach of this Agreement causes us loss, or leads to a claim against us by someone else, you agree to cover our reasonable costs.
6.5 What this does not affect
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law, or affects your statutory rights as a consumer.
7. Dispute Resolution
7.1 Governing law
These Terms are governed by the laws of England and Wales. If you are a consumer resident in the United Kingdom or the European Economic Area, this does not deprive you of the protection of any mandatory consumer protection laws of your country of residence.
7.2 Informal resolution
If you have a dispute with us, please contact us first via our contact form so we can try to resolve it. You agree to attempt to resolve any dispute with us informally and in good faith for at least 30 days before commencing formal proceedings.
7.3 Jurisdiction
The courts of England and Wales have non-exclusive jurisdiction over any dispute arising from these Terms or your use of the Service. If you are a consumer resident in the United Kingdom or the European Economic Area, you may also bring proceedings in the courts of your country of residence.
8. Termination
We may suspend or terminate your account if you breach these Terms, if we reasonably believe you are a risk to other users, or if we are required to by law. You may close your account at any time through the settings in the app, or by contacting us. If your account is ended, you lose access to anything you have bought in the Service, except where the law gives you a refund. Sections that by their nature should continue after termination, including those on content, liability and disputes, will do so.
9. Changes to these Terms
We may update these Terms and will notify you of significant changes. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
10. Contact Information
If you have any questions about the Service, these Terms of Service, the Acceptable Use Policy, the Privacy Policy or the Refunds Policy, please contact us via our contact form.
